I still keep seeing older 30-day and 60-day termination of tenancy notices being circulated. I don’t know if it’s because these old forms are still on the Internet, but I do know that I’ve had very disappointed landlords come into my office with these old notices. I have to tell them that we will have to issue a new termination notice because their notice does not have the tenant belongings disclosure per Civil Code 1946, which reads as follows:
State law permits former tenants to reclaim abandoned personal property left at the former address of the tenant, subject to certain conditions. You may or may not be able to reclaim property without incurring additional costs, depending on the cost of storing the property and the length of time before it is reclaimed. In general, these costs will be lower the sooner you contact your former landlord after being notified that property belonging to you was left behind after you moved out.
This disclosure needs to be on all 30-day and 60-day notices and has been required since January 1, 2013. Yet this problem still comes up. If your notice does not have this disclosure, it is very old and you need to update it. You don’t want to come to the 59th day of your 60-day notice and find out that you need to reissue the 60-day notice because your notice does not have this disclosure.
